These Terms of Service (“Terms”) govern your access to and use of Clubbr, including Clubbr
Marketplace and Clubbr Events (together, the “Services”).
Clubbr is operated by Anuj Attarde trading as Clubbr (“Clubbr”, “we”, “us” or
“our”).
By creating an account, listing tickets or purchasing tickets through Clubbr, you agree to
the applicable Terms. Please also review our Privacy Policy, which explains how we handle personal information. Your legal rights are not affected by
any provision of these Terms that cannot lawfully restrict them.
1. About Clubbr
1.1 Clubbr Marketplace
Clubbr Marketplace enables eligible users to list, buy and sell event tickets.
Tickets listed on the Marketplace are offered by independent sellers. Unless expressly
stated otherwise, the contract for the ticket being resold is between the buyer and seller,
not Clubbr.
Clubbr provides the technology and transaction services used to facilitate purchases,
delivery and payouts. We are not the original ticket issuer, event organiser or venue
operator for Marketplace tickets.
1.2 Clubbr Events
Clubbr Events provides online ticketing services to societies, student organisations and
other event organisers (“Organisers”).
For Clubbr Events, the identified Organiser is responsible for the event itself, including
its programme, venue arrangements, attendance rules, admission policies and event-specific
conditions.
Clubbr provides ticketing and related administrative services, which may include accepting
payments, issuing tickets, maintaining attendee records and providing ticket scanning
facilities.
Where agreed with an Organiser, Clubbr acts as its ticketing and payment collection agent.
The identity of the Organiser and applicable conditions should be displayed as part of the
event’s purchase information.
Clubbr’s involvement in administering ticket sales does not by itself mean Clubbr organises,
promotes or operates the event. Clubbr remains responsible for its own obligations under
applicable law.
1.3 Independence
Clubbr is not operated by or officially endorsed by the University of Warwick. Individual
events may be organised by societies or other organisations affiliated with the University.
2. Eligibility and accounts
2.1 Age
You must be at least 18 years old to use Clubbr and must satisfy any higher age requirement
applicable to an event.
2.2 Marketplace eligibility
Marketplace accounts are intended for eligible University of Warwick students. You must
provide a valid Warwick email address and complete any verification steps required by
Clubbr.
Verification of an email address establishes control of that address; it does not guarantee
that a user, listing or ticket is trustworthy.
2.3 Clubbr Events eligibility
Eligibility for Clubbr Events varies by event. Some events may be open to the public, while
others may be restricted to students, society members or another specified group.
Organisers may require evidence of eligibility. Ticket purchasers are responsible for
satisfying the conditions disclosed before purchase. Where guest checkout is enabled,
purchasing a ticket does not necessarily require a Clubbr account.
2.4 Account security and information
You must provide accurate information, protect your account access and notify us promptly if
you suspect unauthorised activity. You must not impersonate another person, deliberately
provide false eligibility details or use an account without authorisation.
We may restrict accounts reasonably suspected of fraud, misuse or violation of these Terms.
3. Clubbr Marketplace: selling tickets
3.1 Seller obligations
By listing a ticket, you confirm that:
You have lawful possession of the ticket and the right to sell or transfer it.
The ticket is genuine, valid and has not already been used.
All listing information is accurate and not materially misleading.
Relevant restrictions have been disclosed, including name matching, identification
requirements, membership conditions and transfer restrictions.
You will not sell or transfer the same ticket after its sale through Clubbr.
You will comply with applicable laws and relevant event conditions.
You must provide applicable ticket information required by law, including the original face
value, seating or standing area information, and restrictions on use where relevant.
3.2 Named and restricted tickets
Some organisers require the name on a ticket to match the attendee’s identification or
restrict transfers. You must disclose known restrictions before listing. The fact that a
ticket has been listed on Clubbr does not mean the original organiser has approved its
transfer. Clubbr cannot override lawful admission requirements imposed by an organiser or
venue.
3.3 Prohibited listings
You must not list counterfeit, duplicated, stolen, already-used or materially misrepresented
tickets, or tickets you are not entitled to transfer. Clubbr may remove listings, restrict
access or investigate suspicious activity.
4. Clubbr Marketplace: buying tickets
Before purchasing, buyers should review the listing, event date, price, restrictions and
entry requirements.
Venue admission remains subject to the rules and decisions of the relevant organiser or
venue, provided those rules and decisions comply with applicable law. Purchasing a ticket
through Clubbr does not guarantee admission in circumstances outside Clubbr’s control.
These provisions do not remove any legal rights a buyer may have where a ticket is invalid,
materially misdescribed or otherwise fails to meet applicable legal requirements.
Tickets purchased through Clubbr may not be relisted through Clubbr unless an expressly
supported resale process permits it.
5. Marketplace disputes and refunds
5.1 General position
Marketplace purchases are normally final once completed. There is ordinarily no
discretionary refund simply because a buyer changes their mind or can no longer attend. This
does not affect applicable statutory rights or rights arising from a seller’s
misrepresentation or breach of contract.
5.2 Reporting deadline
Buyers must normally report problems involving invalid, duplicated, already-used or
materially misdescribed Marketplace tickets to Clubbr within 24 hours after the event ends.
This deadline applies to Clubbr’s ordinary Marketplace dispute investigation process.
Reports submitted outside that period may be harder to investigate and may fall outside our
normal internal dispute process.
The reporting deadline does not extinguish statutory rights or prevent a person from using
any legally available payment dispute or chargeback procedure.
5.3 Investigations
Clubbr may request relevant evidence from buyers and sellers, including ticket information,
purchase records and evidence concerning admission. We may investigate reports and take
proportionate action, including restricting accounts, suspending listings, withholding
outstanding payouts or arranging refunds where appropriate.
A report does not automatically entitle a buyer to a refund, and Clubbr does not guarantee a
particular investigation outcome.
5.4 Seller responsibility
Sellers remain responsible for providing tickets that comply with their listings and
applicable obligations. Where a seller has provided an invalid or materially misrepresented
ticket, Clubbr may take reasonable steps to recover associated losses or refunded amounts
from the seller, subject to applicable law and the circumstances of the transaction.
6. Marketplace payments and seller payouts
6.1 Payments
Payments are handled using third-party payment service providers, including Stripe.
Available payment methods and total charges are displayed during checkout.
6.2 Payout timing
Clubbr aims to initiate Marketplace seller payouts within 48 hours after the relevant
event has ended, rather than within 48 hours of the ticket sale.
This is an operational target, not a guarantee that money will reach the seller’s bank
account within that period. Payment processing times, weekends, bank holidays and banking
arrangements may affect when funds become available.
6.3 Payout holds
Clubbr may reasonably delay or withhold a payout where necessary because of:
A ticket validity dispute or unresolved complaint.
Suspected fraud or misuse.
A chargeback or payment reversal.
Incorrect or incomplete payout details.
Compliance, security or payment-provider requirements.
Material operational difficulties.
We will aim to resolve payment holds within a reasonable period.
6.4 Seller bank details
Sellers are responsible for providing accurate payout information. We process and protect
bank information as described in our Privacy Policy. We may require verification before
processing or changing payout instructions.
6.5 Payment reversals
Where a transaction is reversed or refunded, related seller payments may be adjusted or
recovered where lawful and appropriate.
7. Clubbr Events: purchasing tickets
7.1 The Organiser’s role
Tickets purchased through Clubbr Events are issued for events managed by the Organiser
identified in the event information. The Organiser determines the event’s attendance
conditions, eligibility criteria, schedule, venue rules and ticket restrictions, subject to
applicable law. Clubbr provides the ticketing infrastructure and administrative services.
7.2 Event-specific conditions
Individual events may have additional terms governing:
Age, identification or student eligibility.
Society membership.
Admission and re-entry.
Entry deadlines.
Dress codes and venue rules.
Ticket transfers.
Cancellation, postponement and refunds.
Other reasonable event-specific conditions.
Where applicable, these conditions must be made available before purchase. Event-specific
conditions supplement these Terms and govern the relevant event arrangements. They cannot
override statutory rights or remove Clubbr’s own legal obligations.
7.3 Guest checkout
Where enabled, users may purchase tickets without registering for a Clubbr account. Guest
purchasers must provide information reasonably required to process and deliver their
tickets. Guest checkout does not exempt purchasers from applicable event conditions.
7.4 Ticket delivery
Following successful payment and satisfaction of any required approval checks, tickets will
normally be issued electronically. Tickets may include unique identifiers or QR codes used
for entry validation. Purchasers must safeguard tickets and avoid sharing ticket codes with
unauthorised individuals.
7.5 Ticket scanning
Clubbr or authorised event staff may validate tickets using scanning tools. A ticket may be
rejected if it has already been used, is invalid, has been cancelled or fails to satisfy
applicable admission conditions. Technical validation does not override the Organiser’s
lawful admission rules.
8. Clubbr Events: membership and manual approval
Certain ticket releases may require the purchaser or attendee to satisfy membership or other
eligibility conditions. Where manual approval is required:
The purchaser may be asked for membership information or an associated email address.
Payment may be collected before eligibility has been confirmed.
The order or ticket issuance may remain pending while an Organiser reviews eligibility.
A ticket will only be issued following approval where configured that way.
The applicable event or release conditions will explain the consequences of rejection,
including refund arrangements. A purchase subject to approval does not guarantee approval.
If approval is refused, Clubbr will arrange any refund due under the applicable disclosed
terms and law. Fees may only be retained where properly disclosed and legally permissible.
Clubbr may administer approval, but the Organiser is generally responsible for establishing
and applying its membership eligibility requirements.
9. Clubbr Events: cancellations, changes and refunds
9.1 Event cancellations
If an event is cancelled, refund arrangements will be handled in accordance with applicable
consumer law and the Organiser’s lawful, disclosed event conditions. Clubbr may process
refunds under the Organiser’s instructions as its ticketing agent. Ticket prices and booking
fees will be treated in accordance with disclosed conditions and statutory requirements.
9.2 Postponements and material changes
Where an event is postponed or materially changed, the Organiser is responsible for deciding
and communicating available arrangements, subject to purchasers’ legal rights. Clubbr may
assist with communications and eligible refunds.
9.3 Voluntary cancellations
Unless event conditions or applicable law provide otherwise, purchasers should not assume a
refund simply because they cannot or no longer wish to attend. For leisure activities on a
specified date or period, the ordinary 14-day distance-selling cancellation right will
generally not apply where the relevant statutory exception is satisfied. This does not
remove other applicable consumer rights.
9.4 Admission refusals
The Organiser or venue may refuse admission where a purchaser fails to satisfy valid and
properly disclosed entry conditions. Refund eligibility depends on the circumstances, event
conditions and law.
9.5 Refund requests
Purchasers should contact Clubbr support or follow the Organiser’s specified refund process.
Clubbr may need to consult the Organiser before processing a request. The Marketplace’s
24-hour internal reporting deadline does not automatically apply to Clubbr Events
purchases.
10. Clubbr Events: ticket transfers
Tickets may be transferred only where the relevant Organiser permits transfers and a
supported transfer mechanism is available. Transfers may be restricted to eligible attendees
or require verification. An unauthorised transfer may result in refusal of admission where
the restriction is lawful and properly disclosed. Clubbr Events tickets are not
automatically eligible for resale through Clubbr Marketplace.
11. Fees and prices
Clubbr may charge buyer fees, seller fees or ticketing service fees. Applicable prices, fees
and the total amount payable will be disclosed before payment is confirmed. Fee
refundability depends on disclosed terms, circumstances and legal requirements. Clubbr does
not guarantee that all payment methods will be available for every transaction.
12. Acceptable use
You must not:
Commit fraud or impersonate others.
Misrepresent tickets, eligibility or event information.
Interfere with ticket verification systems.
Deliberately duplicate or distribute tickets without authorisation.
Circumvent security controls or attempt unauthorised access.
Introduce malicious code or disrupt the Services.
Use automated scraping or abusive traffic contrary to law or access restrictions.
Use Clubbr to facilitate unlawful transactions.
We may apply reasonable restrictions to protect users, organisers and the Services.
13. Organisers and authorised administrators
Organisers and authorised administrators are responsible for ensuring event information,
admission rules, membership requirements and instructions given to Clubbr are accurate and
lawful. They must use attendee information only for legitimate, appropriately disclosed
purposes, comply with data protection requirements and restrict access to authorised staff.
Clubbr may suspend organiser access where reasonably necessary to address misuse, security
risks or serious breaches. Separate agreements may apply between Clubbr and Organisers;
those agreements do not remove purchasers’ statutory rights.
14. Intellectual property and user content
Users retain their rights in content they lawfully submit. By submitting content, users
grant Clubbr a limited licence to store, display, transmit and process it as reasonably
necessary to operate the Services. Users must not submit content that infringes another
person’s rights or violates law. Clubbr retains its rights in its website, software,
branding and proprietary materials.
15. Service availability and limitations
We aim to keep Clubbr reliable and available but cannot guarantee uninterrupted access.
Third-party services, venues, payment providers and communications networks may experience
disruptions beyond our reasonable control. Clubbr is not responsible for organising or
operating third-party events merely because tickets are purchased through the platform.
Nothing in these Terms removes responsibility Clubbr may have for its own failure to
exercise reasonable care and skill or for other obligations imposed by law.
16. Liability
Nothing excludes or limits liability for death or personal injury caused by negligence,
fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded
or limited. Nothing removes applicable consumer rights or remedies.
Subject to those protections, Clubbr is not responsible for losses caused solely by
independent sellers, organisers or venues where those losses are outside Clubbr’s legal
responsibility and reasonable control. We are not responsible for losses arising from users
breaching properly disclosed and lawful ticket restrictions. Any limitation applies only to
the extent lawful and fair under consumer protection legislation.
17. Suspension and termination
Clubbr may suspend or terminate access where reasonably necessary because of fraud, security
risks, material misuse, repeated breaches or legal requirements. Where practicable and
appropriate, we may explain the restriction. Termination does not automatically remove
outstanding contractual obligations or legally required records.
18. Changes to these Terms
We may update these Terms to reflect changes to our Services, operations or legal
requirements. Material changes will be communicated where reasonably appropriate. Changes
will ordinarily apply prospectively and will not retrospectively remove rights or materially
alter concluded transactions where doing so would be unlawful or unfair. The current version
will be available on this page.
19. Governing law
These Terms are governed by the laws of England and Wales, subject to mandatory consumer
protections. Nothing removes rights concerning the jurisdiction of courts that consumers are
entitled to under applicable law.
